Understanding Wage and Hour Laws in Connecticut


Wage disputes in Connecticut often arise when employers fail to meet legal payment obligations. Employees have legal protections under §31-72 of Connecticut's General Statutes, which allows them to recover unpaid wages, sometimes with double damages and attorney's fees.

 

Key Highlights:
  1. Wage Claims and Double Damages:
    Employees can sue for unpaid wages and may receive twice the owed amount unless the employer proves good faith compliance with the law.

  2. Bonuses and Tips:
    Non-discretionary bonuses tied to performance may qualify as wages. Employers must follow strict rules regarding tips for service workers.

  3. Statute of Limitations:
    Employees have two years to file claims, which can be paused if a complaint is submitted to the Labor Commissioner.

  4. Employee Status and the ABC Test:
    Determining employee classification involves proving independence from the employer’s control, working outside the employer's core business, and operating independently in the trade. If you are currently classified as a "1099" you may still be entitled to protections.

  5. Legal Fees:
    Cases are often handled on a contingency basis, with lawyers receiving a portion of the recovery or court-awarded fees.

  • Prohibitions on penalizing employees for discussing wages.

  • Protections against forced social media disclosures or attending political/religious events.
